Terms & Conditions

These Terms & Conditions apply to services provided by Laura Kemps, trading as Assistly Salford (“Assistly Salford”, “I”, “me” or “the Service Provider”) to individual clients (“you” or “the Client”).
By confirming that you agree to these Terms & Conditions (e.g. by submitting the Assistly Salford New Client Form), you agree that they will apply to the services provided to you.
1. About Assistly Salford
Assistly Salford provides household and disability support to individuals and families.
The purpose of the service is to provide practical assistance with household tasks, errands, shopping, leisure activities and day-to-day activities, helping clients manage their household and maintain their independence.
Laura Kemps, trading as Assistly Salford, is a self-employed service provider and is not an employee, nursing service or personal care provider.
2. Services Provided
Services are tailored to the individual needs of each client and may include, but are not limited to:
- General household assistance and organisation
- Light cleaning and tidying as part of general household support
- Laundry and changing beds
- Meal preparation and cooking
- Grocery shopping and other errands
- Accompanying clients to leisure activities and other agreed activities
- Transporting clients in the Service Provider’s vehicle where agreed and appropriate
- Practical assistance with day-to-day activities
- Assistance with children while parents or carers are present
- Occasional babysitting or brief childcare
- Other reasonable household or practical support tasks agreed between the Client and Assistly Salford
The specific tasks carried out during individual sessions may vary according to the Client’s needs, priorities and the time available.
Services not provided
Assistly Salford does not provide:
- Personal care, including assistance with bathing, toileting, dressing or other intimate personal care
- Administration or management of medication
- Nursing, medical or clinical care
- Deep cleaning or professional cleaning services
- Cleaning as a standalone or primary service
- Regular or full-time childcare as a primary service
- Services requiring specialist professional qualifications or training that the Service Provider does not hold
Assistly Salford reserves the right to decline any task that is considered unsuitable, unsafe, outside the scope of the service, or beyond the Service Provider’s skills, training or insurance.
3. Arranging Services and Availability
Services are arranged by mutual agreement between the Client and Assistly Salford.
The frequency, duration and timing of sessions may vary depending on the Client’s requirements and the Service Provider’s availability.
Regular sessions may be arranged on an ongoing basis without requiring a separate booking confirmation for each visit.
The Service Provider will make reasonable efforts to accommodate the Client’s preferred schedule but cannot guarantee specific days or times unless expressly agreed.
4. Fees and Payment
The Client’s hourly rate will be confirmed separately in writing, normally by email, when services are arranged.
The agreed rate is specific to the individual Client and does not form part of these general Terms & Conditions.
Unless otherwise agreed, services are charged based on the actual time spent providing the service, subject to any applicable minimum session length.
The minimum service time is 2 hours per session, unless otherwise agreed.
Charging time
For services carried out at the Client’s home, chargeable time begins when the Service Provider enters the Client’s home and ends when the Service Provider leaves.
Where services are carried out away from the Client’s home, chargeable time begins when the agreed service starts and ends when the agreed service finishes.
For journeys undertaken solely to complete errands on behalf of the Client, chargeable time begins when the Service Provider leaves their place of residence and ends when they return to the Client’s home, unless otherwise agreed.
Timesheets
Services may be recorded using a timesheet or other record of hours worked.
Where a timesheet is used, the Client may be asked to confirm the hours worked. Failure to sign or confirm a timesheet does not automatically mean that payment for services provided is not due.
Invoicing and payment
Invoices are normally issued monthly and are payable by bank transfer within 7 days of the invoice date.
The Client is responsible for ensuring that invoices are paid by the due date, including where services are funded through Direct Payments or another funding arrangement.
The Client remains responsible for payment of any amount that is not covered by their funding arrangement.
Assistly Salford is responsible for its own tax and National Insurance obligations as a self-employed business.
5. Travel and Additional Expenses
Where the Client requests travel for shopping, errands, leisure activities or other agreed purposes, a mileage charge of 55p per mile may apply to journeys outside a 1-mile radius.
Mileage is calculated based on the distance travelled for the relevant journey.
Additional costs incurred at the Client’s request, such as parking charges, tolls or other reasonable travel-related expenses, may also be charged to the Client and will be itemised on the relevant invoice.
Where the Service Provider transports the Client in their vehicle, this forms part of the agreed household and disability support service and is not offered as a taxi or private-hire service.
6. Cancellations and Rescheduling
The Client should provide at least 24 hours’ notice if they need to cancel or reschedule an agreed session, except in cases of genuine emergency or circumstances outside their reasonable control. This also applies where changes are made at the last minute to the length of a session; if the Service Provider agrees to adjust the start or finish time accordingly, the Client will still be charged for at least the originally agreed duration.
Where the required notice is not provided, the Client may be charged for the previously agreed working time.
Where no specific working time has been agreed, a late cancellation fee of £40 may apply.
The Service Provider will take reasonable circumstances into account when applying cancellation charges.
If Assistly Salford needs to cancel a session due to illness, an emergency or another unavoidable circumstance, the Client will be informed as soon as reasonably possible.
Where appropriate and available, the Service Provider may offer a suitable substitute.
7. Client Responsibilities
The Client is responsible for:
- Providing accurate and relevant information about their needs and circumstances
- Informing Assistly Salford of any information that may affect the safe provision of services
- Providing suitable access to the property at the agreed time
- Providing any household cleaning products, materials or equipment required for tasks they have requested
- Providing a safe and suitable working environment
- Informing Assistly Salford about relevant hazards, allergies, pets or other circumstances that may affect the provision of services
- Paying invoices within the agreed payment period
The Service Provider may decline to carry out tasks that are outside the agreed scope of services or that may be unsafe.
8. Health and Safety
Both the Client and Assistly Salford have a responsibility to take reasonable steps to maintain a safe environment.
The Client must inform the Service Provider of any known hazards or circumstances that could reasonably affect their safety while providing services.
Assistly Salford may refuse or stop a task if it is considered unsafe or if appropriate equipment, information or conditions have not been provided.
Any accident, injury, damage or significant safety incident occurring during the provision of services should be reported as soon as reasonably possible.
Where an immediate risk to health or safety exists, the Service Provider may leave the property or stop providing the relevant service.
The Client must inform Assistly Salford as soon as reasonably possible if they, or someone in their household, has a known or suspected contagious or infectious illness that could reasonably pose a risk to the Service Provider or other clients.
Where Assistly Salford reasonably believes that providing services could create a significant risk of infection to the Service Provider, particularly where this could subsequently pose a risk to other potentially vulnerable clients, Assistly Salford reserves the right to cancel, postpone or modify the service.
Where suitable, Assistly Salford will discuss alternative arrangements with the Client, such as rescheduling the visit or providing appropriate support remotely.
9. Substitution
Assistly Salford reserves the right to arrange for a suitable substitute to provide services where necessary, for example due to illness, holidays or other circumstances.
Where a substitute is used, Assistly Salford will ensure that they are suitable for the services required.
The Client will not be charged an additional amount solely because a substitute is used.
Where the Client has specific requirements regarding a substitute, these should be discussed with Assistly Salford in advance where possible.
10. Confidentiality
Assistly Salford will treat personal, household, financial and other private information shared by the Client as confidential.
Confidential information will not be disclosed to third parties except where:
- The Client has given permission;
- Disclosure is necessary to provide the agreed service;
- Disclosure is required by law; or
- Disclosure is necessary to protect the Client, the Service Provider or another person from a serious risk of harm.
The Client is also expected to respect the Service Provider’s privacy and confidentiality.
11. Insurance and Liability
Assistly Salford maintains appropriate insurance for the services provided.
The Service Provider will take reasonable care when carrying out agreed tasks and will take reasonable precautions to avoid causing injury or damage.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
The Client remains responsible for providing suitable equipment, materials and access to their property where these are required for the requested task.
The Service Provider is not responsible for loss or damage resulting from circumstances outside their reasonable control or from unsafe, defective or unsuitable equipment or materials supplied by the Client, except where the Service Provider has acted negligently or is otherwise legally responsible.
12. Changes to Services or Agreed Fees
The services provided to an individual Client may be adjusted from time to time by mutual agreement.
The Client’s agreed hourly rate is confirmed separately from these general Terms & Conditions.
Assistly Salford may review its fees from time to time. Any change to an existing Client’s agreed rate will be communicated in writing and will normally be provided with at least 30 days’ notice before taking effect.
13. Ending the Service
Either the Client or Assistly Salford may end the ongoing service arrangement by giving one week’s written notice, unless a different notice period has been agreed in writing.
Immediate termination may take place where there is a serious or material issue that makes continuing the service unreasonable or unsafe. This may include serious non-payment, abusive or threatening behaviour, serious breaches of health and safety requirements, or other serious misconduct.
Any outstanding invoices or other amounts due for services already provided remain payable following termination.
14. Complaints and Dispute Resolution
If the Client has a concern or complaint about the service, they should raise it with Assistly Salford as soon as reasonably possible so that an opportunity can be given to resolve the matter.
Both parties agree to try to resolve disputes reasonably and in good faith.
Where appropriate, the parties may consider mediation or another form of Alternative Dispute Resolution before commencing court proceedings.
15. Changes to These Terms & Conditions
Assistly Salford may update these Terms & Conditions from time to time where necessary, for example to reflect changes to the services, business practices or legal requirements.
Reasonable notice will be provided before the updated Terms & Conditions take effect and will be made available to the Client.
16. Governing Law
These Terms & Conditions are governed by the law of England and Wales.
Any disputes will be dealt with by the courts of England and Wales, subject to any rights the Client may have under applicable consumer protection legislation.
17. General
These Terms & Conditions, together with any individual arrangements agreed in writing between Assistly Salford and the Client, form the basis of the service arrangement.
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.
No provision of these Terms & Conditions affects any statutory rights the Client has under applicable law.
